Question:
A company called Windham Proffesionals is trying to collect a debt
that was paid in full. Problem is I don't have a reciept. The loan was
co-signed by a friend and according to this collection agency is
responsible. What do you do? Is this a scam? They can't seem to be
able to produce any kind of document other than the loan application.
The bank who made the loan back in 1987 says they have no record of my
account. Help!!!

-First of all I am not a lawyer and this is my own opinion.
Banks usually keep a record of the loan for 7 years AFTER THE PAYOFF.
I would double-check with the bank to MAKE SURE they
have no record of the loan and GET IT IN WRITING. If they do
not have a record of the loan, seems to me, you and your friend
do not owe anything.
-Contact the collection agency and tell them that you prefer to settle
the debt with the original party. I believe that they are required to
them forward your account back to the original party. If the
originating bank has no documentation of the initial debt, then that
should certainly end the problem.
